TERMS OF SERVICE
How working together works, in writing.
These terms apply when you book, buy or take part in any of my programmes, and when you use this website. They're written to be read, not skimmed past. If anything is unclear, ask me before you sign up.

1. Who you are agreeing with
Mary Arianne, trading as Mary Arianne, established in Wageningen, registered with the Chamber of Commerce under number 92719546. In these terms: "I", "me", "my".

"You" means the person booking or taking part in a programme, or using this website.
2. What I offer, and what it isn't
Please read this one
I am a fertility awareness educator and cycle & hormone coach. I am not a doctor, nurse, midwife, dietitian or psychologist, and nothing I provide is medical advice, diagnosis or treatment. My work is education, coaching and support. It does not replace care from a qualified medical professional, and I will tell you when something needs one.

I don't diagnose conditions, prescribe or advise you to stop, start or change medication, including hormonal contraception. Those decisions are yours, ideally made with your doctor.

I don't promise specific outcomes. Bodies differ, and how much changes depends on many things, including what you do between sessions.

If at any point I believe your situation is outside what coaching can help with, I'll say so and refer you on.​
3. How an agreement is made

You book a free introduction call. No agreement exists yet and nothing is owed.

If we decide to work together, I send you a coaching agreement by e-mail with the programme, price, payment plan and start date, together with the intake questionnaire and the consent form from section 9.

The agreement is made when you confirm in writing (e-mail or e-signature) and the first payment is received. Your place is held from that moment.

These terms are part of every coaching agreement. If the agreement and these terms ever say different things, the agreement wins.
4. The programmes
​1:1 Holistic Cycle & Hormone Coaching (3 to 4 months): includes an intake questionnaire and first call, a written health and cycle review, personal guidelines and tools, 1 follow-up call, support between calls, and a final reassessment.
Natural Birth Control programme (12 weeks, with support for 6 months): includes a free introduction call, the 12-week FAM programme, three live 1-on-1 sessions with chart reviews, private support for 6 months from sign-up, printable FAM chart and reference material, and 3 months of Read Your Body charting.
The exact content is described on each programme page at the time you sign up. I may improve materials during a programme; you'll always receive at least what you were promised.

Programme validity. Sessions must be used within 6 months of your start date unless we agree otherwise in writing. Unused sessions after that lapse.
Support between sessions means e-mail or whatsapp messages during my working hours, Monday to Friday. I try to reply within 2 working days. It's not a crisis line: if something is urgent, contact your doctor or emergency services.

These terms are part of every coaching agreement. If the agreement and these terms ever say different things, the agreement wins.
5. Prices and payment

Prices are in euros and include VAT. The price at the time you sign up is the price you pay, even if I raise prices later.

Pay in full: due before the first session.

Instalments (2 or 3 payments): the first is due before the first session; the rest on the same date in the following months. Instalments are a payment convenience, not a subscription: you are committing to the full programme price.

Payments run through Wix Payments and PayPal. I never see your card details.

If an instalment fails, I'll let you know and you have 7 days to fix it. After that I may pause sessions and support until it's settled. Amounts still owed remain due.If a payment remains overdue after that 7-day period, statutory interest applies from the due date until it's paid in full, in addition to any reasonable costs I incur in recovering it.
6. Cancelling and refunds
In short​
You can change your mind for 14 days after signing up. Once we've started, the programme is paid for, but you can pause, and I'm always open to talking.

Your 14-day right of withdrawal
Because you buy online, you have a legal right to cancel within 14 days of signing up, without giving a reason. E-mail me and I'll refund everything you've paid.
You don't need to use a specific form, a clear e-mail to hello@maryarianne.com saying you want to withdraw is enough. If you'd rather use a model withdrawal form, let me know and I'll send you one.

If you ask me to start the programme within those 14 days (for example, your first session is in week one) and we do, you agree that you'll owe a proportionate amount for what has already been delivered, and that once the programme is fully delivered the right of withdrawal no longer applies.

After 14 days

Programmes are not refundable once started. This is a one-to-one commitment: your place, my preparation and the reserved sessions can't be given to someone else.

If you're on instalments, the remaining payments stay due.

Pausing: life happens. You can pause once for up to 8 weeks without any charge. Just tell me in writing.

If something serious makes it impossible for you to continue (long-term illness, bereavement), talk to me. I'd rather find a fair solution than hold you to a rule.
If I have to cancel
If I can't deliver the programme, for illness or anything else on my side, you get a full refund of everything not yet delivered, or we reschedule, your choice.

7. Force majeure
Sometimes something happens that's outside my control and stops me delivering a session or programme as planned, for example sudden illness, a family emergency, technical failure, fire, flooding or loss of data.

If this happens, I'll let you know as soon as I can, and we'll agree a new date or a reasonable alternative.

If a situation like this lasts longer than 8 weeks, either of us can end the affected part of the agreement. Anything already delivered is settled fairly, and nothing you've paid for undelivered sessions is lost.
8. Sessions and rescheduling

Sessions are online via google meets at the length stated for your programme.

You can reschedule free of charge up to 48h before a session.

Less than 24 hours notice, or not showing up, counts as a used session. I make one exception per programme, no questions asked.

If you're late, the session still ends at the planned time.

Sessions are not recorded unless we both agree in advance.
9. What I ask of you

Be honest and complete in your intake and in sessions. I can only work with what you tell me.

Tell me about any diagnosed condition, medication or pregnancy, at the start or when it changes. Some things affect how charting and coaching work.

Keep seeing your doctor for anything medical. Coaching sits alongside medical care, not instead of it.

Do the observing and charting. Especially in the birth control programme, the method only works if you do the daily work.
10. Health data, consent & confidentiality
To coach you I need information about your cycle, contraception, symptoms and health history. This is "special category" data under the GDPR and I can only process it with your explicit consent.
Before your programme starts you'll be asked to confirm the following. It's also written into the coaching agreement.

I give Mary Arianne explicit consent to collect and use information about my menstrual cycle, contraception, symptoms, medication and health history for the sole purpose of delivering my coaching programme. I understand this data is stored only in the tools listed in her Privacy Statement, is never shared or used for any other purpose, and that I can withdraw this consent at any time by e-mail, after which the data is deleted except where the law requires it to be kept. I have read the Privacy Statement.

Everything you share with me in sessions, by e-mail or by WhatsApp is confidential. I don't discuss it with anyone else, including a partner, family member or employer, even if they ask.
The only exception: if I believe there's a serious and immediate danger to your safety or someone else's, I may share what's necessary with emergency services or another appropriate authority.

Withdrawing consent ends the coaching, because I can't coach without the information. Payments already made for sessions delivered aren't refunded; see section 6.
Everything else about your data is in the Privacy Statement, which is part of these terms.​​​

11. Natural birth control: specific terms
​Read before signing up for this programme
​
The fertility awareness method is a method of identifying fertile and infertile days. It is not a contraceptive device or medication. Its effectiveness depends entirely on correct observation, charting and strict application of the rules on fertile days. I teach the method; I cannot chart for you or guarantee that you will apply it correctly. No method of contraception is 100% effective. By enrolling, you accept that you are responsible for how you use what you learn, and that the risk of pregnancy when using this method is yours.

During the learning phase (at least the first charted cycle, or as long as I advise), you should treat every day as potentially fertile or use a barrier method, until we've confirmed together that you're reading your charts reliably.

I will tell you plainly if I believe you're not yet ready to rely on the method. Please take that seriously.

If a pregnancy would be unacceptable to you, and you're not able to follow the rules strictly on fertile days, this programme is not the right fit and I'll say so on the introduction call.

Read Your Body is a third-party app with its own terms. The 3 months of free charting is a credit provided through my educator account; after that, any subscription is between you and them.
12. Liability

I deliver my services with care and to the best of my knowledge and training. What I provide is education and coaching; I'm not liable for medical outcomes, including pregnancy, that result from how you apply what you've learned.

I'm not liable for indirect damage, including loss of income or missed opportunities.

Where I am liable, my liability is limited to the amount you paid for the programme in question.

Nothing in these terms limits liability that can't legally be limited, such as for intent or gross negligence.
13. Materials and copyright
Everything I give you (charts, guidelines, the written review, reference material, trackers, this website) is my work and stays my copyright. You may use it for yourself, print it, keep it forever. You may not share, sell, publish or teach from it without my written permission.
Your own charts and notes are yours.
14. Using the website

The content on this site is general education. It isn't tailored to you and isn't medical advice. Don't make decisions about medication or contraception based on it alone.

I try to keep everything accurate and current, but I can't guarantee the site is error-free or always available.

Links to other sites are there because I find them useful. I'm not responsible for their content.

By downloading a free product or subscribing, you agree to receive occasional e-mails from me. Unsubscribe any time, one click.
15. Changes and applicable law
I may update these terms. The version that applies to you is the one in force when you signed your coaching agreement. Website terms apply from the date shown at the top.

These terms are governed by the law of the Netherlands. Disputes go to the competent court in Wageningen, but I'd much rather we talked first. As a consumer you always keep the protections of the law of the country you live in.
16. Complaints
If something isn't right, tell me. E-mail hello@maryarianne.com with what happened and what you'd like to see resolved.

I'll confirm I've received your complaint and aim to respond within 14 days. If I need more time to look into it properly, I'll let you know within that period.
​
If your complaint is justified, I'll put it right, for example with a replacement session or an adjustment to what's owed, depending on the situation. This doesn't affect your rights under section 6.
